Government enacts Planning and Development (Housing) and Residential Tenancies Act 2016

On Friday, the new Minister for Housing, Planning, Community and Local Government, Eoghan Murphy, T.D.  signed the Commencement Order and supporting Regulations to enable planning applications for large-scale housing developments of 100 units or more, and large-scale student accommodation projects, to be made directly to An Bord Pleanála.

With effect from Monday 3 July 2017, developers will be able to submit planning applications for large housing developments, known as strategic housing developments, directly to the Board, instead of local planning authorities.

The regulations provide further detail on the content and detail required to accompany pre-application consultation requests and applications.  A series of new forms for statutory notices and applications are also included.

The new Act and Regulations are widely regarded in the industry as the planning reform that nobody wanted, but everybody has been left to deal with.

FAC can advise developers how to deal with the legislation and whether it is the only option for all strategic housing in all local authorities. For further information, please call us on 01 639 4836 or email us at info@futureanalytics.ie.
